Booking Terms: Custom Itineraries

By choosing Just Add Flights, Inc. to plan your vacation, you signify your agreement with the following terms and conditions upon payment of deposit:

1.Travel Documents: You must send copies of all traveler’s passports and information about any dietary restrictions by email to alison.hurley@justaddflights.com. You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on your documents must match your government-issued I

2.Agent for Suppliers: Just Add Flights, Inc. (“Just Add Flights”) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

3.Risks of Travel and Release: We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at travel.state.gov, click on “Find International travel Information” then click on “Country Information,” and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

4.Entry & Re-entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Please be aware that entry and re-entry rules are subject to change, whether your travels are foreign or domestic. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

5.Fees: You agree to make an initial deposit of 25% of the total trip cost plus any Services that require pre-payment. The remaining fees are due 90 days prior to your first day of service with Just Add Flights. Your failure to pay fees timely or to otherwise abide by these Terms of Service shall allow us to cancel your trip and seek all other legal recourse under law and equity.

6.Price Drops: If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

7.Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

8.Trip Modifications: If, after booking your trip, you want to change your itinerary we will pass on the request to the relevant Supplier(s). However, we cannot guarantee that such changes can be made, and you will be charged for any additional costs incurred including cancellation charges. Note that a change of name on or other alterations to an airline ticket will usually incur a 100% cancellation charge and full rebooking fee.

9.Trip Cancelation: If you have to cancel part or all of your trip, you must send us written notification by email to alison.hurley@justaddflights.com. All trip cancelation requests will be evaluated on a case-by-case basis and charges will be applied according to the scale below:

•If a cancelation request is received 90 or more days before departure, Just Add Flights will retain the initial deposit + any advanced payments and return the balance amount.

•If a cancelation request is received 61-90 days before departure, Just Add Flights will retain 50% of the total trip cost + any advance payments and return the balance amount.

•If a cancelation request is received 31-60 days before departure, Just Add Flights will retain 75% of the total trip cost + any advance payments and return the balance amount.

•If a cancelation request is received less than 30 days before departure, Just Add Flights will retain 100% of the total trip cost.

The charges above only reflect a percentage of the total trip cost and do not include any trip modification fee or other third party charges which may be due and payable.

10.Trip Credit: Occasionally, we may have to make changes to itineraries, hotels and other arrangements before and/or after bookings have been confirmed. While we always try to avoid changes and cancellations, we reserve the right to do so. If, because of changes we had to make, the updated costs for Services are higher than the original costs, you agree to pay us the difference. By contrast, because of changes we had to make, if the updated costs for Services are lower than the original costs, you will be entitled to receive partial credits from us for future use.

We will only cancel your confirmed booking in case of your failure to pay the trip cost in full prior to departure or when we are forced to cancel as a result of “force majeure” as defined below. In the event of a change or cancellation precipitated by a force majeure event, we will offer you a trip credit for a future date.

11.Force Majeure: We cannot accept liability, make refunds, or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss, injury, death, inconvenience or damage as a result of circumstances amounting to “force majeure.” “Force majeure” means any event or circumstance which we or the supplier of the services in question could not avoid. This may include circumstances but are not limited to, acts of God, actual or threatened, war, insurrection, riots, strikes, civil action, acts by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity, or the treat thereof, industrial action, natural or nuclear activity, epidemics/ pandemics or the threat thereof, adverse weather conditions, fire and all similar events outside our control.

12.Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. We are happy to provide options for you to purchase this through. We recommend making this purchase within 7 days of booking to receive the "Cancel for Any Reason" stipulation. Should you elect not to purchase travel insurance you agree to hold us harmless for any resulting loss or denial of claim

13.Credit Card Merchant: We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

14.Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. These Terms are governed by Delaware law and you agree that the courts in the State of Delaware will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

Payment Instructions

- Make a deposit of 25% + any services that require pre-payment. We will secure hotels, tours, flights, and transfers as they become available. This payment can be made by credit card via Stripe, a link will be sent to you when you are ready to book.

- Fill out the booking form (will provide it at a later date)

- Send copies of your passport to alison.hurley@justaddflights.com

- Send any dietary restrictions that we need to be aware of

-Purchase travel insurance (recommended for all customers). We are happy to provide options for you to purchase this through. We recommend making this purchase within 7 days of booking to receive the "Cancel for Any Reason" stipulation.

Your final balance will be due 90 days prior to your first day of services with Just Add Flights.

Flights

At Just Add Flights we do our best to help with booked flights; however, the airlines are known to be difficult to work with.

Seating

We are happy to request seats for you, this may incur additional costs to your itinerary depending on the airline.

Baggage

We try to provide flights that have a minimum of 1 x 50 lb piece of luggage to be checked and a personal item to take on as a carry-on. If you need additional luggage allowance, this will be an additional charge incurred through the airline.

Frequent Flyer Programs

When your airfare is booked through Just Add Flights, you can collect points if you provide your Frequent Flyer information to us; however, you cannot use your points to pay for upgrades.
